1. About these terms

This website is operated by Stamp Lab (ABN 36 007 918 406). "We", "us" and "our" refer to Stamp Lab. "You" refers to the person using this website or placing an order.

By using this website or placing an order, you agree to these Terms of Service, together with our Privacy Policy, Refund & Warranty Policy and Shipping Policy, which form part of these terms.

If you don't agree, please don't use the website or place an order.

2. Who can order

You must be at least 18 years of age to place an order. By ordering you confirm you are 18 or older, or that a parent or guardian has consented and accepts responsibility for the order.

3. Products and pricing

  • All prices are in Australian dollars and include GST unless stated otherwise
  • Prices and product availability may change without notice
  • Live stock levels are shown on each product page; out-of-stock items are marked
  • We may limit quantities, refuse or cancel any order, and discontinue any product

Images and media are illustrative. Photographs, renders and other media show our products but may not be an exact depiction of the item you receive β€” colours in particular vary between screens. Please rely on the written product description and specifications, and ask us if you need clarification before ordering.

4. Errors in pricing or product information

We take care to keep our website accurate, but errors happen. If we discover a material error in the price or description of a product you have ordered, we will contact you before dispatch. You may confirm the order at the corrected price or cancel it for a full refund. We will not simply charge you a higher price without your agreement.

5. Orders and acceptance

Placing an order is an offer to buy. A contract is formed when we accept your order β€” normally when we send a dispatch notification, or for custom products, when we begin manufacture following your proof approval.

We may decline an order, including where the product is unavailable, where there has been a pricing error, where we cannot verify your details, or where section 8 applies.

6. Custom products and proof approval

Most of our products are made to your specification.

  • We produce a proof for your approval before manufacture
  • Your approval of the proof is the final specification for your order. Please check spelling, names, dates, registration numbers and layout carefully
  • Once you approve a proof and manufacture begins, the order cannot be cancelled or changed
  • If the finished product matches your approved proof, it is not faulty β€” see section 5 of our Refund & Warranty Policy
  • If it does not match your approved proof, we will remake it at our cost

7. Artwork you supply

Where you supply artwork, logos, signatures or text, you confirm that you own the rights to it or have permission to use it, and that using it will not infringe anyone else's rights.

You agree to indemnify us against any claim arising from artwork or content you supply.

We may refuse any artwork or content we reasonably consider unlawful, offensive, infringing, or misleading, and will refund you in full if we do.

We do not claim ownership of artwork you supply. We retain a copy so that repeat and replacement orders can be produced accurately β€” see our Privacy Policy.

8. Products carrying professional or legal authority

Some products we sell β€” including legal practitioner, Justice of the Peace, notary, medical practitioner and provider number stamps β€” carry professional or legal authority. Using such a stamp without the relevant authority may be a criminal offence.

By ordering such a product you confirm that you hold the professional registration, appointment or authority it represents, or are ordering on behalf of a person who does. You are responsible for ensuring the product is used lawfully.

We reserve the right to request evidence of entitlement, and to refuse or cancel any order where we are not satisfied that a product will be used lawfully. We may report suspected fraudulent orders to the relevant authority.

9. Payment

We accept the payment methods shown at checkout, including cards processed by Shopify Payments and Stripe, PayPal, and the buy-now-pay-later services Afterpay and Zip Pay.

We do not store your full card details. Payment is taken at the time of order unless we agree otherwise in writing.

Buy now, pay later. Where you pay using Afterpay or Zip Pay, your payment arrangement is a separate agreement between you and that provider, governed by their terms and subject to their approval. We are paid in full at the time of your order. Any questions about your instalments, fees or account are matters for that provider. Where we refund an order paid this way, the refund is returned through the provider and applied to your arrangement with them β€” you may need to continue meeting scheduled instalments until they process it.

12. Your consumer rights

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded.

13. Our liability

Subject to section 12:

  • Where goods or services we supply are not of a kind ordinarily acquired for personal, domestic or household use, our liability for failure to comply with a consumer guarantee is limited, at our option, to replacing or repairing the goods, supplying equivalent goods, or paying the cost of doing so β€” to the extent permitted by section 64A of the Australian Consumer Law and where it is fair and reasonable to do so.
  • Otherwise, and to the maximum extent permitted by law, our total liability arising from or in connection with any order is limited to the amount you paid for that order.
  • To the maximum extent permitted by law, we are not liable for indirect or consequential loss β€” including loss of profit, revenue, opportunity, goodwill or data, or costs arising from delay β€” except where that loss is a reasonably foreseeable consequence of our failure to comply with a consumer guarantee.
  • We are not liable for loss arising from circumstances we were not told about. If an order is time-critical or failure would cause consequences beyond the value of the goods, tell us in writing before ordering so we can advise whether we can meet your requirement.
  • We are not liable for delays or failures caused by events outside our reasonable control, including carrier delays, supplier failures, natural events, and utility or telecommunications outages.

14. Website availability

We aim to keep the website available but do not guarantee uninterrupted or error-free access. We may suspend, withdraw or change any part of the website without notice.

15. Acceptable use

You must not use this website:

  • For any unlawful purpose, or to encourage unlawful activity
  • To infringe our intellectual property rights or those of others
  • To harass, abuse, defame or discriminate against any person
  • To submit false or misleading information
  • To transmit viruses or malicious code
  • To collect others' personal information, or to spider, crawl or scrape the site
  • To interfere with or circumvent the security features of the site

We may terminate your access for breach of this section.

16. Our intellectual property

The content of this website β€” including text, product descriptions, photographs, graphics, logos and layout β€” is owned by us or our licensors and is protected by copyright and trade mark law. You may not reproduce, distribute or commercially exploit it without our written permission.

17. Third-party links and tools

Our website may link to third-party sites or provide access to third-party tools. We don't control them, we're not responsible for their content or practices, and their use is at your own risk under their terms.

18. Feedback and submissions

If you send us ideas, suggestions or feedback, you agree we may use them without restriction, confidentiality obligation or payment. This does not apply to artwork or content supplied as part of an order, which is covered by section 7.

19. Privacy

Your personal information is handled in accordance with our Privacy Policy.

20. Changes to these terms

We may update these terms from time to time. The current version is always on this page with the date last updated. Changes apply to orders placed after they are published β€” we will not change the terms of an order you have already placed.

21. If part of these terms doesn't apply

If any provision of these terms is found unlawful, void or unenforceable, that provision is severed and the remaining provisions continue in force.

22. Governing law

These terms are governed by the laws of Queensland, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Queensland.

Nothing in this section limits your right to bring a claim in another forum where the law gives you that right β€” including the Queensland Civil and Administrative Tribunal (QCAT) or the ACCC.
